Acceptance of Yacht Rental Conditions
These general charter terms and conditions govern the rights and obligations of the lessee ("Client") and the lessor ("Charter Company"). Allure Navis Charter Agency, referred to as "Allure Navis" or the "website," is the Charter Company. By making the first payment as specified in the 'Booking Confirmation Agreement,' the Client agrees to all rental conditions on behalf of their crew, acknowledging that the payment signifies agreement equivalent to a personal signature.
Rental Price and Payment
The rental price includes the boat lease with standard equipment, boat, and crew insurance. Excluded are domicile marina costs, fuel, skipper/hostess service, and other optional services. The Client secures the boat by paying 50% of the rental price upon request approval and the remaining 50% at least 6 weeks before the rental date. Payment terms cannot be modified without Allure Navis' consent.
Obligations of the Charter Company
The Charter Company commits to providing the boat in full commission, in proper working order, with all necessary equipment, filled water and fuel tanks, and delivered at the agreed time with documentation. Failure to fulfill these conditions grants the Client reimbursement rights. If a reserved boat is unavailable, the Charter Company must provide a substitute with equal or better specifications. If the boat or equipment is damaged due to natural causes, the Charter Company must rectify the damage within 24 hours. Reimbursement rights are excluded in such cases.
Deposit
Before taking responsibility for the boat, the Client must settle a security deposit to the Charter Company. The deposit, calculated based on the boat's length/value, is refundable upon satisfactory boat return. Damages or missing equipment may result in deposit deductions.
Obligations of the Client
The Client agrees to sail in Croatian territorial waters unless special written approval is obtained to leave. The Client must follow all navigation rules, maintain a boat log, care for the boat, and sail only in favorable weather conditions with good visibility. The Client must possess navigational skills, required licenses, and inform the Charter Company of any accidents or damage promptly.
Responsibilities of the Client
The Client is liable for damages resulting from gross negligence or reckless boat maneuvering. Costs related to lack of engine oil, damages to the underwater section, or failure to pay the crew are the Client's responsibility.
Boat Inspection
The Client must return the boat on time, clean, undamaged, and with full fuel tanks. Late returns incur additional charges. Late returns due to force majeure, with immediate notification, may be justified.
Insurance
The boat, its equipment, and crew are insured for various risks, excluding damages from reckless conduct or gross negligence. The Client must report accidents promptly and inform the Charter Company. Failure to report may result in liability for damages.
Rental Cancellation
Cancellation results in retention of the entire rental amount. Exceptions may apply with insurance coverage or unforeseen circumstances. Secret Adriatic may substitute a damaged boat with an equal or better specification.
Crew
If crew members are hired, the Client must treat them well, provide provisions if not agreed otherwise, and return the boat on the last night by 18:00 hours
Complaints
Clients must inform the Charter Company and Allure Navis of any complaints during the charter period. Only written objections during the boat inspection will be considered.
